WARRANTY

 

MILO Insulation warrants MILEX™ to be free of manufacturer defects when installed in a free-standing residential home for as long as you own your home, from the completion date of product installation. In order for the warranty to be valid, MILEX™ MUST be installed in accordance with MILEX™ Published Specifications; and is free from any defect in material, or manufacturing, that would adversely affect its original insulating efficiency at the time of insulation.

 

WHO IS COVERED?  

 

This warranty is valid for the original purchaser and is transferable to the next homeowner. Warranty can be transferred one (1) time ONLY. For this warranty to be transferred, and remain in effect, the current homeowner must inform new homeowner of existing warranty AND the new homeowner must notify MILO Insulation within one-hundred and twenty (120) days, or 4 months, of the real estate transfer.

LIMITATIONS

 

This warranty does not apply to, and MILO Insulation shall not be liable for, damage due to any cause not expressly covered herein. This warranty does not cover any problems with non-defective product or installation caused by conditions or handling beyond the control of MILO Insulation or an authorized installer or dealer. Examples of conditions not covered by this warranty include failures or defects in the product or installation caused by: causes beyond normal and proper use including, but not limited to: acts of God, war or terrorism, fire, excessive moisture, flood, wind or other weather damage, or exposure to chemicals or the environment; or installation services provided by anyone other than a MILO Insulation authorized installer or dealer; or non-manufacturing defects, including but not limited to improper installation, maintenance, neglect, accident, casualty, vandalism, misuse, ice, ice damning, failure or defect of the product or installation resulting from an alteration made to the structure of the home or business, or any other cause that disturbs or disrupts the product as installed; or any costs incurred by you that are not authorized in advance by MILO Insulation. MILEX™ Thermal Puffs may experience a normal "settling" of up to three (3) inches as thermal puffs interlock and tighten when home, building or structure, periodically shakes from wind, thunder, earth tremors, slammed doors or any other event, or act of God, that may cause the house, building or structure to shake. This normal settling does not affect the insulation effectiveness and, as such, is NOT considered "shrinkage" or a manufacturers defect.   

 

ANY IMPLIED WARRANTY, INCLUDING THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR USE OR PURPOSE AND THE WARRANTY OF MERCHANTABILITY, IS LIMITED IN DURATION TO THE EXPRESS WARRANTY PROVIDED HEREIN UNLESS A SHORTER PERIOD IS PERMITTED BY LAW. MILO INSULATION SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR FOR DAMAGE TO THE BUILDING, ITS CONTENTS OR ITS OCCUPANTS. THIS WARRANTY CONTAINS ALL OF THE PROVISIONS OF PURCHASER’S REMEDIES FROM MILO INSULATION. MILO INSULATION'S LIABILITY IS LIMITED TO THE PROVISIONS OF THIS WARRANTY, WHETHER ANY CLAIM AGAINST IT IS BASED UPON STRICT LIABILITY, NEGLIGENCE, BREACH OF WARRANTY OR ANY OTHER THEORY OR CAUSE OF ACTION.  FURTHER, MILO INSULATION’S LIABILITY SHALL BE EXPRESSLY LIMITED TO THE TOTAL PAYMENT MADE TO MILO INSULATION FOR THE GOODS AND SERVICES PROVIDED TO THE CUSTOMER.

 

Some states do not allow limitations on how long an implied warranty lasts and/or do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights and you may also have other rights that vary from state to state.
